Law firm assists Parish Council in opposing dissolution proposals
Else Solicitors LLP have assisted Greasley Parish Council in successfully opposing proposals to dissolve and split it between neighbouring Parishes, as part of a recent Community Governance Review conducted by Broxtowe Borough Council.
Broxtowe Borough Council recommended the change in May 2024, but following consultation and the instruction of Else Solicitors LLP on behalf of Greasley Parish Council, it was concluded that the proposal to dissolve Greasley Parish Council and create a new Parish Council comprising of all of Eastwood, Giltbrook, Newthorpe and Moorgreen and outlying properties in Greasley, was not in the interests of the local communities.
Had the proposal succeeded, it was noted that there would be a negative on impact on community cohesion.
Furthermore, Broxtowe Borough Council acknowledged that they could be at risk of legal challenge and costs, if they were to proceed.
The Community Governance Review was undertaken by the Borough Council who consulted on proposals that, if implemented, would have led to the dissolution of Greasley Parish Council.
The majority of residents of the parish who expressed a view were opposed to the proposal and with the assistance of Else Solicitors LLP, Greasley Parish Council argued that the process undertaken by the Borough Council was unlawful and that there was no satisfactory explanation as to why the proposed option, which went far beyond boundary adjustments, was being proposed.
